Terms of service

By using productharvest.org or hosted Winnow at usewin.now, you accept these terms. If you don't agree, please don't use them.

For hosted-Winnow accounts, your subscription is also subject to the pricing and billing terms shown at checkout, which form part of this agreement.

These terms cover:

• productharvest.org — the public marketing site, including the waitlist and contact forms.
• Hosted Winnow at usewin.now — the per-customer hosted version of the Winnow software.

These terms don't cover:

• Self-hosted Winnow. When you install Winnow yourself, the open-source license (the AGPLv3 license) governs your use of the code. We're not a party to your self-hosted installation in any sense.
• Third-party LLM providers. When you bring your own key (BYOK) — Anthropic, OpenRouter, or another — your relationship with that provider is governed by their terms. We pass requests through; we are not the LLM provider.
• Third-party services you connect. When you wire Winnow up to n8n, Zapier, Slack, GitHub, Notion, or anything else, those integrations are subject to the third party's terms.

To use hosted Winnow, you need an account, created via an invitation sent through Clerk. You're responsible for keeping your account credentials safe and for everything that happens under your account. Tell us as soon as you can if you suspect unauthorised access.

One person per account at v1. Team accounts are on the roadmap.

When using the marketing site or hosted Winnow, you agree not to:

• Try to break, disrupt, or probe the site or service in ways that interfere with normal use.
• Scrape the marketing site abusively, or use automated tools to consume the service in ways inconsistent with normal usage.
• Upload malicious code, attempt unauthorised access to other accounts, or circumvent any security or access control.
• Use the service to do anything illegal, infringing, defamatory, harassing, or in violation of third-party rights.
• Use the service to develop or train a product that competes with Winnow.
• Resell, sublicense, or commercialise the hosted service without our written permission. (Self-hosting is governed by the open-source license — different rules.)

We may suspend or terminate access if we reasonably believe these rules are being broken. For serious or repeated breaches we may terminate without notice.

You own the data you put into hosted Winnow — every piece of evidence in raw/, every page in wiki/, every foundation file. You retain all rights to it. We don't claim any ownership.

You grant us a narrow licence to host, store, back up, transmit, and display that data only to the extent needed to operate the service for you. That's it. We don't use your data to train models, share it with third parties, or look at it without cause. See the privacy policy for the full data-handling story.

You are responsible for:

• Ensuring you have the right to put your content into Winnow (e.g. that customer data is processed under a lawful basis, that confidential third-party material is allowed in).
• The accuracy of foundations, decisions, and delivery records you author.
• Anything the LLM produces from your data — recommendations are proposals, not facts, and humans decide what to ship.

Hosted Winnow uses a large language model — your own, via BYOK — to maintain the wiki, propose opportunities, and draft recommendations. LLM outputs:

• Are best-effort syntheses based on the evidence and foundations you provide.
• May contain errors, omissions, or misinterpretations. We've designed the system to surface confidence and risks explicitly, but a low-confidence flag is not a substitute for human review.
• Are not professional advice. Don't use them as a substitute for legal, financial, medical, or other regulated guidance.
• Are subject to the LLM provider's terms in addition to ours.

You are responsible for reviewing what the system writes before acting on it. The reconcile flow exists specifically because foundations should never change without human approval.

The marketing-site copy, designs, screenshots, and brand assets on productharvest.org are ours. You can quote and link reasonably for commentary, criticism, or news; otherwise please ask before reusing.

The Winnow software itself is open-source under the AGPLv3. The license — not these terms — governs your rights to use, modify, and redistribute the code. If anything in these terms appears to conflict with the open-source license for the Winnow code, the license wins.

You retain all rights in your content. We retain all rights in the service.

Hosted Winnow is provided on a commercially reasonable best-effort basis. We don't guarantee uptime at v1 — for SLA-bearing arrangements, talk to us about an enterprise tier (none exists today; this is a forward-looking note).

We may add, change, or remove features; deprecate older behaviour; or change the underlying infrastructure. Where changes are material and likely to affect you, we'll give you reasonable notice.

The marketing site is provided "as is" — we may take it down, change it, or evolve it without notice.

If you subscribe to hosted Winnow:

• The price, billing frequency, and what's included are shown at checkout and on the pricing page.
• Subscriptions are processed by Stripe and renew automatically until you cancel.
• You can cancel at any time from the Stripe Customer Portal, accessible from your /account page.
• On cancellation, your workspace enters a 30-day export window: it remains accessible for read-only export. After 30 days, the container and its persistent volume are destroyed (GDPR-clean).
• We don't refund mid-cycle by default. If something has gone meaningfully wrong, get in touch and we'll be reasonable.

Prices are exclusive of VAT or sales tax unless explicitly stated. Where applicable tax law requires it, tax will be added at checkout.

You provide your own LLM API key. Your LLM costs are billed by your provider directly, not by us. We don't mark up tokens, rate-limit per-customer, or reconcile usage. If your provider's pricing changes, that's between you and them.

To the maximum extent permitted by law:

• The marketing site and hosted Winnow are provided "as is" and "as available", without warranties of any kind, express or implied.
• We don't warrant that the service will be uninterrupted, error-free, secure, or fit for any particular purpose.
• We don't warrant that LLM outputs are accurate, complete, suitable for your context, or compliant with any regulatory regime.
• Any third-party content, links, or integrations are not endorsed by us; we make no representations about them.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law (in the UK: death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded).

To the maximum extent permitted by law:

• Neither party will be liable for indirect, consequential, special, or incidental damages arising out of or relating to these terms or the service — including loss of profits, revenue, data, goodwill, or anticipated savings — even if advised of the possibility.
• Our aggregate liability under or in connection with these terms (whether in contract, tort including negligence, or otherwise) is capped at the total amount you've paid us in the twelve months before the event giving rise to the claim. For free / waitlist / marketing-only users, the cap is £100.

These limits don't apply to liability that can't lawfully be excluded — see Disclaimers above.

You can stop using the marketing site at any time. You can cancel a hosted-Winnow subscription at any time from your account.

We can suspend or terminate access if you breach these terms, if your subscription is overdue and unresolved, if required by law, or if we discontinue the service. Where reasonable, we'll give you notice and an export window.

On termination:

• Your access stops.
• Your data is exported / deleted per the cancellation flow above.
• The provisions that should survive termination (intellectual property, disclaimers, limitation of liability, governing law, anything else by its nature) survive.

We may update these terms. The Last updated date at the top changes when they do. For material changes affecting existing users, we'll notify you directly by email and where reasonable give you advance notice. Continued use after a change takes effect counts as acceptance of the updated terms.

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them, except that we may bring proceedings to enforce our intellectual property rights in any jurisdiction.

If you're a consumer, mandatory consumer-protection rules in your country of residence still apply where they offer you greater protection.

If any part of these terms is found unenforceable, the rest stays in force. Our failure to enforce a right isn't a waiver of it. These terms are the entire agreement between us about the marketing site and hosted Winnow, replacing any prior discussion. You can't transfer your rights or obligations without our written consent; we can transfer ours as part of a sale or restructure.
